— A 5-year-old Rock Hill boy was left with redness on his skin and small cut on his neck after police say his drunk family member assaulted him after deciding he did not want to play anymore on Saturday.

Officers were sent to a South Cherry Road home at about 8:30 p.m. when a 51-year-old woman, reported that James Smarr, 57, of Rock Hill assaulted her nephew, according to a Rock Hill police report.

The woman told police that Smarr and the boy had been playing. Smarr decided that he did not want to play anymore, police say, and grabbed the boy by his throat and threw him onto a bed. Police spoke with the victim, who corroborated his aunt’s claims.

The victim’s mother told police that she wanted to press charges.

Smarr was arrested and charged with third-degree assault and battery.
