Niemann and Earla Jean Niemann, Defendants. NOTICE OF PENDENCY OF ACTION: NOTICE IS HEREBY GIVEN that an action has been commenced and is now pending or is about to be commenced in the Circuit Court upon the complaint of the above named Plaintiff against the above named Defendant for the purpose of foreclosing a certain mortgage of real estate heretofore given by Shaun Niemann and Earla Jean Niemann to Nationstar Mortgage LLC bearing date of May 28, 2002 and recorded June 10, 2002 in Mortgage Book 4426 at Page 48 in the Register of Mesne Conveyances/Register of Deeds/Clerk of Court for York County, in the original principal sum of One Hundred Fourteen Thousand Three Hundred Sixty Three and 00/100 Dollars ($114,363.00). Thereafter, by assignment recorded in the said ROD Office on December 7, 2011 in Book 12307 at page 307, the said Mortgage Electronic Registration Systems, Inc. (MERS) as nominee for Countrywide Home Loans, Inc. assigned said mortgage to Bank of America, N.A., Successor By Merger To BAC Home Loans Servicing, LP Home Loans Servicing, LP FKA Countrywide Home Loans Servicing, LP; thereafter, by assignment recorded May 28, 2013 in Book 13445 at page 196, the said Bank of America, N.A assigned said mortgage to Nationstar Mortgage, LLC., and that the premises effected by said mortgage and by the foreclosure thereof are situated in the County of York, State of South Carolina, and is described as follows: All that certain piece, parcel or lot of land lying, being and situate in the Ebenezer Township, York County, South Carolina, and being designated as Lot 1 on Plat of Property of India Hook United Methodist Church, recorded in Plat Book 45, page 183, and being more recently shown on Plat of Property Surveyed for Phillips Sweeney and Deborah Sweeney, drawn by J.B.
