NOTICE OF SALE Docket No. 2012-CP-46-3157 By virtue of a Decree of the Court of Common Pleas for York County, heretofore granted in the case of The Bank of New York Mellon, formerly known as The Bank of New York, as Trustee for the Certificateholders of the CWABS, Inc., Asset-Backed Certificates, Series, 2005-12, Plaintiff vs. Antwain D. Johnson, Tamara Johnson, David G. Anderson and Founders Federal Credit Union, Defendants; I, the undersigned Master in Equity for York County, will sell on Monday, August 4, 2014, at 11:00 o'clock A.M, in the Master's Courtroom, at the Master's Office, 1 North Congress Street, York, South Carolina, across West Liberty Street from the York County Courthouse, to the highest bidder, the following described property, to wit: All that certain piece, parcel or lot of land, with the improvements thereon, situate, lying and being in the City of Rock Hill, Catawba Township #3, York County, South Carolina and being more particularly described as follows: Beginning at a stake on the northern side of Melchers Drive at a point 343.2 feet east from the intersection of Melchers Drive and Tremont Avenue, joint front corner of Lots 7 and 8, Block 21, as shown upon the plat below mentioned; thence with the line of Melchers Drive N. 85 59 E. 95 feet to stake, front corner of Lots 6 and 7 in Block 21; thence with the line of said lots N 4 01 W 227.5 feet to stake; thence S. 78 25 W 95.9 feet to stake, rear corner of Lots 7 and 8; thence with the line of said lots S. 4 01 E. 215 feet to the beginning; being shown and designated as Lot 7, Block 21, upon a plat entitled "Map of Extension of Eastview Subdivision" prepared by W.C. White, RLS, May 11, 1962, revised August 24, 1962, recorded in Plat Book 24 at page 30, known as 1033 Melchers Drive. TMS# 628-16-03-012. Said property is the same property conveyed to Antwain D. Johnson and Tamara Johnson by Deed of David G. Anderson, dated June 3, 2005, recorded June 21, 2005 in the Office of the Clerk of Court for York County in Record 7179 at page 291. CURRENT ADDRESS OF PROPERTY IS: 1033 Melchers Drive Rock Hill, SC 29730 TERMS OF SALE: FOR CASH: The Master in Equity will require a deposit of Five (5%) per cent of the amount of bid (in cash or equivalent), same to be applied on the purchase price only upon compliance with the bid, but in case of non-compliance within thirty (30) days after the date of the sale, same to be forfeited and applied to costs and the property re-advertised for sale upon the same terms at the risk of the former highest bidder. The sale shall be subject to taxes and to existing easements and restrictions of record. Purchaser shall pay for all costs of recording the deed. The successful bidder will be required to pay interest on the amount on the bid from the date of the sale to the date of compliance with the bid at the rate of 8% per annum. Since a personal and deficiency judgment has been demanded, the bidding will remain open for a period of thirty days, and will close on Wednesday, September 3, 2014, at 11:00 o'clock A.M.
