YORK — A judge has ruled that York County can have a moratorium on landfills.
Judge John Hayes turned down a request by the city of Rock Hill and Griffin Brothers Co.'s for an injunction against the county, which had put a 60-day halt to any new landfills while it developed a new solid waste plan. The city questioned the legality of the moratorium.
In two concisely written orders, Hayes said the court could not restrain the county's legislative power.
In a three-hour hearing Wednesday afternoon, Rock Hill and the company's attorneys asked for an injunction to prevent the county from adopting the new solid waste plan and from enforcing a moratorium on landfills.
