Advocates plan to sue Duke Energy over ash

Three environmental groups have filed challenges to state permits that let Duke Energy dump coal ash into open-pit clay mines in Lee and Chatham counties.

The challenges were filed in state administrative court.

They claim, among several allegations, that the permits would hurt neighbors’ property values and were issued illegally by the Department of Environment and Natural Resources.

The Blue Ridge Environmental Defense League, Chatham Citizens Against Coal Ash Dump and EnvironmentaLEE filed the petition with the Office of Administrative Hearings.

Duke will pay both counties to take its ash. Chatham County will be paid $1.50 a ton up to 12 million tons and get additional payments in lieu of property taxes. Lee County will get $1.50 a ton up to 8 million tons of ash.
