Rock Hill man seeking Hardee’s burger special arrested for DUI in drive-thru

A Rock Hill man who police believe was driving under the influence was arrested on Saturday afternoon after causing a disturbance at a local Hardee’s drive-thru.

Officers were called to the Herlong Avenue restaurant after employees reported a customer using the drive-thru who appeared to be intoxicated, was speaking slowly and was slurring his words, according to a police report. First, the man left the restaurant’s drive-thru window but returned shortly after, once police were en-route to Hardee’s.

Several officers responded and found the man sitting in his car at the drive-thru window. When an officer asked the man to roll down his window, he mistakenly hit the car’s door lock button and then had difficulty putting his vehicle in park, as requested.

Police say the 51-year-old man also had difficulty retrieving his driver’s license as requested, even though the license was in plain view inside the car.

He told officers that he was at Hardee’s for a $1.36 burger special he’d heard about on TV.

The man failed field sobriety tests but was found to not have alcohol in his system, the police report states. He told police he’d taken one Xanax pill the night before.

Police arrested the man on suspicion of DUI but he refused to give a urine sample for drug testing, according to the report. He was taken to Rock Hill city jail.
