We all know the rules of the road when it comes to speeding.

White speed limit signs with black lettering are plastered along roadways letting drivers know how fast they’re allowed to go. And going faster than the posted speed limit on those signs could lead to a ticket that comes with a hefty fine.

But what about the yellow speed limit signs?

Referred to as advisory speed limit signs, according to the Federal Highway Administration, yellow speed limit signs are “a non-regulatory speed posted for a small portion or isolated section of a roadway (e.g., a sharp curve, an exit ramp) to inform a driver of a safe driving speed.”

Are yellow speed limit signs enforceable in NC?

According to Master Trooper Christopher Casey with N.C. State Highway Patrol, you can’t get a ticket for exceeding the posted speed limit on a yellow sign in North Carolina.

“Those signs are a suggested speed as you enter certain parts of the roadway and are not enforceable,” Casey told The Charlotte Observer in an email.

What if you get into an accident?

Going faster than the posted speed limit on a yellow sign isn’t illegal, but if you’re involved in an accident while doing so, courts could argue that you violated the state’s fundamental speed law, according to driversprep.com, a DMV test preparation website.

North Carolina’s fundamental speed law requires drivers to travel at a speed that is “reasonable and prudent.”

The basic speed law overrides a posted speed limit when conditions require a lower speed,” driversprep.com says.
