1 dead, 1 hurt in York County crash near Clover; Driver charged with DUI death, injury
A Clover man is charged with DUI in a Sunday crash that left one person dead and another injured, police said.
Jonathan William Malave, 38, is charged with felony DUI resulting in death, and felony DUI resulting in great bodily injury, according to police and jail records.
He faces as much as 40 years in prison if convicted, South Carolina law shows.
Malave was the driver in a single-car crash Sunday night on Baird Road, said Cpl. Matt Southern of the S.C. Highway Patrol.
The passenger who died has not been identified by the York County Coroner’s Office.
Malave was driving a 2001 Acura around 9:40 p.m. when he went off the right side of the road into a culvert before the car went back across the road and off the left side of the road into a ditch where it overturned, Southern said.
Malave, who was wearing a seat belt, was not injured, Southern said.
The passengers were not wearing seat belts, Southern said.
One passenger died at the scene, Southern said. The other passenger was taken to Carolinas Medical Center in Charlotte. The injured passenger’s identity and condition have not been released.
Felony DUI resulting in death carries a prison sentence of up to 25 years for a conviction, South Carolina law shows. A DUI with great bodily injury carries a sentence of up to 15 years for a conviction.
Malave remains in the York County jail without bond.
The fatal crash involving an accused DUI driver was the second in York County over the weekend. On Saturday a Fort Mill man was charged with felony DUI resulting in death after a motorcyclist was killed in a crash.
